Overcoming Bankruptcy Filing Fees
The attorneys at John Turco Law Office are sympathetic to the plight of many Nebraskans and Iowans who could desperately utilize the fresh start of bankruptcy, yet feel stuck in limbo due to the expense to file. According to a new CNN Money article, there is a large segment of the population that will need to file a bankruptcy case this year, but will not have the ability to do so due to the costs associated with filing.

In a cruel twist of fate, the Bankruptcy Abuse Prevention and Consumer Protection Act, or “BAPCPA” (the 2005 overhaul to the bankruptcy code) has priced out a huge number of low-income couples and individuals who badly need the debt relief that bankruptcy can provide. Since the law was passed in 2005, the bankruptcy filing fee has increased from $209 to $306 for Chapter 7 cases. Fees were added for mandatory counseling sessions. The dramatic increase in paperwork and preparation time has caused attorney rates to jump 62% on average.[1]
